HM Customs and Excise argued that Jaffa Cakes are the size of biscuits, packaged as biscuits, eaten with fingers like biscuits, and kept on the biscuit shelf at the supermarket.
United Biscuits countered that a biscuit goes soft when stale, whereas a Jaffa Cake, like a cake, goes hard. The company also maintained that size was of secondary importance, offering as evidence a specially prepared 12-inch Jaffa Cake.
