I would reckon after the MoD has carried out it's investigation if there are criminal charges to be made then the police would be involved at that stage.
Proving that a illegal action had caused the crash of a military helicopter would, I would guess be very difficult to prove by either the service investigation or civil.
It used to be the case that the RAF investigated fixed wing crashes and the RN would cover rotary wing accidents. I don't know if this is still the way it works.
